Skipalis Training & Consultation does not, and shall not, discriminate against, harass, or bully in any aspect against any person because of actual or perceived race, color, religion, age, national origin, mental or physical disability/disability status, sex/gender, pregnancy, military status/status as a veteran, genetic information, citizenship, immigration status, marital status, sexual orientation, gender identity, gender expression, limited English proficiency, language spoken or signed, or other legally protected status.

Skipalis Training & Consultation prohibits discrimination, harassment, and/or bullying in determining eligibility, provision, or termination of services based on actual or perceived race, color, religion, age, national origin, mental or physical disability/disability status, sex/gender, pregnancy, military status/status as a veteran, genetic information, citizenship, immigration status, marital status, sexual orientation, gender identity, gender expression, limited English proficiency, language spoken or signed, or other legally protected status.

It is the policy of Skipalis Training & Consultation to prohibit and prevent any and all harassment and/or bullying on the basis of actual or perceived race, color, religion, age, national origin, mental or physical disability/disability status, sex/gender, pregnancy, military status/status as a veteran, genetic information, citizenship, immigration status, marital status, sexual orientation, gender identity, gender expression, limited English proficiency, language spoken or signed, or other legally protected status.

Harassment and Bullying Policy

Skipalis Training & Consultation is committed to maintaining a work environment that is free of harassment and bullying. In keeping with this commitment, we will not tolerate harassment or bullying of employees, volunteers, or program participants by anyone, including any supervisor, co-worker, vendor, program participant, customer, or other regular visitors of Skipalis Training & Consultation.

Harassment & Discrimination

Harassment and discrimination consists of unwelcome/unwanted conduct (whether verbal, physical, or visual) that threatens, intimidates, or demeans and is based upon a person’s protected status, such as their race, color, religion, age, national origin, mental or physical disability/disability status, sex/gender, pregnancy, military status/status as a veteran, genetic information, citizenship, immigration status, marital status, sexual orientation, gender identity, gender expression, limited English proficiency, language spoken or signed, or other legally protected status.

The conduct of harassment and discrimination forbidden by this policy specifically includes, but is not limited to: (a) epithets, slurs, negative stereotyping; (b) written or graphic material circulated within or posted within the facilities that shows hostility towards a person(s); (c) threats; (d) physical or verbal attacks; (e) intimidation/intimidating acts; or (f) unwanted/unwelcome demeaning behavior based on a person’s protected status.

Sexual Harassment

Sexual harassment deserves special mention. Sexual harassment consists of unwelcome sexual advances, requests for sexual favors, and other physical, verbal, or visual conduct based on sex. This constitutes sexual harassment when:

  • Submission to the conduct is an explicit or implicit term or condition of employment,
  • Submission to or rejection of the conduct is used as the basis for an employment decision, or
  • The conduct has the purpose or effect of unreasonably interfering with an individual’s work performance or creating an intimidating, hostile, or offensive working environment.

Examples of conduct towards an individual of any gender that may constitute sexual harassment include the following:

  • Explicit demands for sexual favors,
  • Sexually-oriented verbal or written kidding, teasing, or jokes,
  • Repeated sexual flirtations, advances, or propositions,
  • Continued or repeated verbal abuse of a sexual nature,
  • Graphic or degrading comments about an individual or his or her appearance,
  • The display of sexually suggestive objects or pictures,
  • Subtle pressure for sexual activity, or
  • Physical contact, such as patting, hugging, pinching, or brushing against another’s body.

Bullying

Bullying (including cyberbullying) means systematically and chronically/persistently (repeated over time) inflicting physical hurt or psychological distress on one or more persons by an individual or group with intent to demean, dehumanize, embarrass, or cause physical harm to a person by direct action, incitement, or coercion. Bullying may involve teasing, social exclusion, threats, intimidation, stalking, physical or verbal attacks, theft, public/private humiliation, destruction of property, or retaliation (e.g. reporting an act of bullying or harassment that is not made in good faith is considered retaliation).

Cyberbullying

“Cyberbullying” means bullying through the use of technology or any electronic communication, which includes, but is not limited to, any transfer of signs, signals, writing, images, sounds, data, or intelligence of any nature transmitted in whole or in part by a wire, radio, electromagnetic system, photoelectronic system, or photo-optical system, including, but not limited to, electronic mail, internet communications, instant messages, or facsimile communications. Cyberbullying includes the creation of a webpage or weblog in which the creator assumes the identity of another person, or the knowing impersonation of another person as the author of posted content or messages, if the creation or impersonation creates any of the conditions enumerated in the definition of bullying. Cyberbullying also includes the distribution by electronic means of a communication to more than one person or the posting of material on an electronic medium that may be accessed by one or more persons, if the distribution or posting creates any of the conditions enumerated in the definition of bullying.

Skipalis Training & Consultation will not tolerate harassing or bullying conduct that places an individual in a reasonable fear of harm to her/his/their person or damage to her/his/their property, affects tangible job benefits, that interferes unreasonably with an individual’s work performance, program eligibility/participation, or that creates an intimidating, hostile, or offensive environment.

Non-Retaliation Policy

Skipalis Training & Consultation forbids retaliation against anyone for reporting, assisting or participating in any manner of investigation, or for opposing alleged unlawful discriminatory practices prohibited by the following federal laws:

  • Title VI and VII of the Civil Rights Act of 1964, as amended;
  • Title IX of the Education Amendments of 1972, as amended;
  • Section 504 of the Rehabilitation Act of 1973, as amended;
  • Omnibus Budget Reconciliation Act of 1981;
  • Age Discrimination Act of 1975, as amended;
  • Age Discrimination in Employment Act of 1967, as amended;
  • Americans with Disabilities Act of 1990

Skipalis Training & Consultation will preserve confidentiality to the extent of applicable laws and the needs of the investigation permit. Skipalis Training & Consultation’s policy is to investigate all such complaints of unlawful discrimination practices thoroughly and promptly. If an investigation confirms that a violation of this harassment policy has occurred, Skipalis Training & Consultation will take corrective action, including such discipline, up to and including immediate termination of employment, as is appropriate. Additionally, when investigating complaints of harassment under this policy, Skipalis Training & Consultation may impose discipline, up to and including discharge, for inappropriate conduct that comes to its attention, without regard to whether the conduct constitutes a violation of this policy.

Discrimination complaints may be filed with: Department of Children and Families (DCF) Office of Civil Rights, U.S. Department of Health and Human Services (HHS) Office for Civil Rights, and/or with the U.S. Department of Justice (DOJ) Office for Civil Rights.
